1. About these terms

These terms apply when you download or use the Last Journal app ("the app") and its optional cloud backup service ("the service"), provided by Aldene Villardo ("we", "us"). By using the app you agree to them. If you don't agree, please don't use the app.

You must be at least 13 years old to create an account.

2. Using the app

We give you a personal, non-transferable licence to use the app on devices you own or control. You may not copy, modify, reverse-engineer or redistribute the app, attempt to extract its source code, make derivative versions, or use our name or trademarks without permission. The app and all intellectual property in it remain ours.

3. Your journal belongs to you

Everything you write, and every photo you add, is yours. We don't claim ownership of it and we don't use it for anything other than providing the service. You give us only the permission needed to store and transfer your encrypted backups on your behalf.

Your journal lives on your device. The app works fully without an account, and your entries and photos never leave your device unless you sign in and back up.

4. Accounts

Signing in is optional and is only needed for cloud backups. You're responsible for keeping your sign-in details secure and for activity under your account.

Signing in with a different method — for example Google instead of email and password — can create a separate account with separate backups, even with the same email address.

5. Premium subscriptions

Premium is an optional subscription, billed monthly or yearly through Google Play. Google Play handles payment, renewal, cancellation and refunds under its own terms. A free trial may be offered to new subscribers.

Backups and photos you upload are stored encrypted in the cloud, subject to limits:

These limits are current as of the effective date. We may change them; we will give you at least 30 days' notice before reducing them.

7. When a subscription ends

Nothing is deleted when a subscription ends.

8. Inactive accounts

If you don't sign in to the app or make a backup for 24 months, we may delete the cloud data stored for your account — backups, photos and encryption keys. We will give you at least 30 days' notice first, by email to your account's address. Signing in or backing up during the notice period keeps your data.

This never affects the journal stored on your device.

9. Encryption and backup passwords

Backups and photos are encrypted on your device before they are uploaded.

You can add an optional backup password. With it set, only someone with the password can read your backups — including us: we cannot recover or reset it for you. If you forget it, the only way forward is "Reset Encryption", which permanently makes every backup protected by the old password unreadable. Entries still on your device are not affected and can be backed up again.

You're responsible for remembering your backup password.

10. Deleting your account

You can delete your account in the app's settings. This permanently deletes the backups, photos and encryption keys stored in the cloud for that account, and then the account itself. It can't be undone. It does not delete the journal on your device.

11. Keep your own copies

We work hard to keep your backups safe, but the service is provided "as is" and we can't guarantee it will always be available, uninterrupted or free of errors. To the fullest extent the law allows, we are not liable for loss of journal entries, photos or backups — including photos that weren't backed up because storage was full, photos removed with "Free up space", and backups made unreadable by a forgotten backup password.

Keep important entries and photos on your device, and export your journal from the app from time to time.

13. Updates, and ending the service

We may update the app, and you may need to install updates to keep using it or the service. We don't promise the app will support every Android version.

We may stop offering the app or the service. If we shut down the cloud backup service, we will give at least 90 days' notice so you can restore everything to your device. We may suspend or close accounts that break these terms or misuse the service.

14. Changes to these terms

We may update these terms. For material changes we will give at least 30 days' notice in the app or by email before they take effect. The date below shows when they last changed. Continuing to use the app after changes take effect means you accept them.

15. Governing law

These terms are governed by the laws of the State of Maryland, United States, and disputes will be handled by the courts of the State of Maryland, United States, except where the law where you live says otherwise.
